Axiology has Submitted Feedback to the European Commission on the Savings and Investment Union

Axiology responds to the European Commission's (EC) consultation on Savings and Investment Union, addressing key challenges and opportunities for improving capital markets in the EU.


In its response, Axiology proposed concrete measures to enhance retail investors’ access and strengthen capital markets. It emphasised the need for a regulatory environment that fosters the development of innovative technologies like DLT (Distributed Ledger Technology). These technologies bring significant changes to capital markets, encourage cross-border investments, and create a more efficient and transparent investment landscape.


"One of the most valuable developments in financial markets is the adoption of DLT (i.e. the tokenisation of traditional financial instruments). It will enhance trust for retail investors and could ultimately benefit retail clients directly by reducing costs and minimising the chain of intermediaries involved in transactions," says Romena Urbonaitė, Chief Compliance Officer at Axiology. "The Savings and Investment Union should be structured in a way that fosters the further development of capital markets, where DLT brings significant changes."

However, this will not be fully operational without a unified supervisory and regulatory framework across the EU. National laws differ, in particular insolvency laws and national company laws. For instance, now we have a situation where an instrument may be classified as a crypto asset in one member state and as a financial instrument in another.


A good example of supervisory convergence is the recent crypto asset regulation (namely, MiCA). ESMA and EBA has done a great job in ensuring supervisory convergence, and now we have a truly unified EU crypto asset regime with minimal national derogations. Furthermore, EU co-legislators are moving in a direction where regulations, rather than directives, are being created (for example, in AI, crypto assets, and crowdfunding regimes). This shift will limit the fragmentation in  a longer term.
